These Terms and Conditions (“Terms”) govern all services provided by Peleceer Group Limited (“we”, “us”, “our”, “Peleceer Group”) to you (“you”, “Customer”, “Shipper”, “Consignee”). By requesting, booking, or using our services, you agree to be bound by these Terms.

2. SCOPE OF SERVICES 2.1 We act as freight forwarders and/or customs agents. We do not act as a common carrier unless explicitly stated in writing. 2.2 We arrange transport with third-party Carriers; the contract of carriage is between you and the Carrier. Our liability is limited to our role as forwarder/agent. 2.3 All services are subject to space, equipment, and regulatory availability.

4. QUOTATIONS & CHARGES 4.1 Quotations are estimates only and valid for [e.g., 14 days] unless stated otherwise. We may adjust for changes in rates, fuel surcharges, currency fluctuations, routing, or regulatory changes. 4.2 All charges are exclusive of VAT and other taxes unless stated. 4.3 Invoices are due within [e.g., 7–30 days] of issuance. 8. LIEN & RIGHT OF SALE We have a general lien over all your Goods/documents in our possession for any unpaid sums. If sums remain unpaid after 30 days’ notice, we may sell/dispose of the Goods at your expense.

9. DANGEROUS/RESTRICTED GOODS You must declare any dangerous, hazardous, or restricted Goods in advance and comply with IATA/IMO/ADR/Kenya regulations. We may refuse or surcharge such Goods.

10. FORCE MAJEURE We are not liable for delays or failure caused by events beyond our reasonable control (e.g., acts of God, war, strikes, port congestion, government orders, pandemics).

11. TERMINATION & CANCELLATION 11.1 Either party may terminate services with 30 days’ written notice. 11.2 Cancellation fees may apply if you cancel after we have incurred costs or committed to third parties.

12. GOVERNING LAW & DISPUTE RESOLUTION 12.1 These Terms are governed by the laws of the Republic of Kenya. 12.2 Any dispute shall first be referred to good-faith negotiation. Failing resolution within 30 days, the dispute shall be referred to arbitration in Nairobi under the rules of the Chartered Institute of Arbitrators (Kenya Branch). The language of arbitration shall be English.

13. PRIVACY & DATA PROTECTION We process your personal and shipment data in accordance with the Kenya Data Protection Act, 2019. See our Privacy Policy [link] for details.

14. GENERAL 14.1 These Terms constitute the entire agreement and supersede prior understandings. 14.2 No variation is valid unless in writing and signed by us. 14.3 If any provision is held invalid, the remainder remains in force. 14.4 We may assign/subcontract any part of the Services.
